法律英语开学篇

为什么要学习法律英语？

 

现如今，法律英语对于法学生及法律人来说已经不仅是锦上添花的一门技术，已经成为了从业必备的实力。

 

法律人的工作范围非常广泛，业务扩展也非常快。对于涉外律师来说，法律英语对涉外律师来说是他们进入这个行业的敲门砖，是在行业中谋求发展的必需品。涉外律师在需要熟练掌握有关涉外法律法规，并通晓外商投资、国际贸易、知识产权保护等法律知识的同时，出众的法律英语能力更是必不可少。这样双方面精通的律师却十分匮乏。

 

对于非涉外律师来说，随着律师行业的发展和业务的扩展，英文合同的审查，英文合同的拟定，专业英文材料的审阅也已经成为非涉外律师工作中的重要部分，而对法律英语知识的匮乏会为工作造成难以逾越的阻碍。

所以，学习法律英语的重要性就不言而喻了。

 

学习法律英语，我们的任务是？

 

法律英语学习初定计划约为一年时间，涉及美国的法律制度、法律教育，英国的法律制度，法律与道德，陪审团，刑事诉讼、被告人的权利，沉默权，财产法，知识产权，侵权法，合同，公司，小额钱债法庭等内容。课中会有法律英语文章、单词、词组、翻译，课后进行消化吸收后，再进行练习巩固

作业要求：

1、单词（百词斩或扇贝）打卡，不少于20个单词；

2、英语新闻朗读；

3、法律英语（自学后）朗读（一分钟内完成）。

The American legal system is a common law system, where cases are settled based on tradition, common practice and interpretation of statutes. As we have already known, as a matter of practice, even in common law countries there are quite a few number of codes of law. But what should be emphasized is that the central feature of the system lies in its reliance on case law or judge-made law. That is, precedents are used as guidance to deal with the same or analogous situations arising today

China's State Administration for Industry and Commerce is reviewing an antitrust complaint accusing Apple Inc of abusing its dominant position in smartphone applications, sources said. The regulator is studying the information following a complaint filed on behalf of developers before deciding if a formal investigation is necessary, said the sources. The review is preliminary and Chinese antitrust agencies usually review such information before deciding whether an official probe is needed. Beijing-based law firm Daxiao, or Dare & Sure, said earlier this month it filed complaints on the developers' behalf to the SAIC and the National Development and Reform Commission. The lawyers accused Apple of removing apps without a proper explanation and taking an excessive 30 percent cut of in-app transactions, it said in an Aug 8 statement
